These terms apply to your use of SearchRealEstate.ca (the "Platform"). By using the Platform, you agree to them. If you don't agree, please don't use the Platform.
1. What we are
SearchRealEstate.ca is a Canadian real estate marketing and advertising platform. We are not a real estate brokerage, mortgage broker, law firm, contractor or other service provider. We do not represent buyers, sellers, landlords or tenants. We don't take part in any deal, and we don't give legal, financial, tax or real estate advice.
2. Members are independent third parties
Members include real estate professionals, mortgage brokers, lawyers, inspectors, contractors, service providers, and private sellers and landlords. Each member is solely responsible for their profile, listings, blog posts, promotional posts and services. Verification only means we checked a member's basic details and payment. It is not an endorsement or a guarantee of their licensing, quality, honesty or results. Before hiring a professional or completing a deal, check their licence with the right regulator yourself.
3. Request forms and referrals
When you send a request (such as New Listing Alerts or Free Home Appraisal) and give consent, you agree that we may pass your details to one or more verified members in your area so they can contact you. Any estimate of value is an informal opinion from the member, not a certified appraisal. We don't guarantee that a member will respond. See our Privacy Policy.
4. Contacting members directly
When you contact a member from a listing, profile, blog post or promotional post, that conversation and any agreement that follows is between you and the member alone.
5. Member accounts and fees
- You must be at least 18, give accurate information, and keep your login secure.
- Profiles need a one-time verification fee and our approval before they go public. The fee is non-refundable once your profile has been reviewed, unless the law requires otherwise.
- We may approve, reject, suspend or remove any member or content at our discretion.
6. Content rules
Members must make sure their content is accurate, lawful and theirs to post. Members must follow all laws and professional rules that apply to them, including provincial real estate advertising rules, Canada's Anti-Spam Legislation (CASL), privacy laws and human rights laws. Do not post anything false, misleading, discriminatory, infringing or spam. Members who receive referrals must use the information only to answer that request and must respect any request not to be contacted. By posting content, you give us a non-exclusive, royalty-free licence to display and promote it on the Platform.
7. Listings and information
Members provide the listings, prices, measurements and other details. We don't check them and don't guarantee they are accurate or available. Confirm all details independently.
8. Prohibited use
Don't scrape, copy or resell Platform data. Don't harvest contact information, interfere with the site, or use it for any unlawful purpose.
9. Disclaimers and liability
The Platform is provided "as is". To the extent the law allows, SearchRealEstate.ca is not liable for any loss arising from your use of the Platform, from any member's or user's content, services or conduct, or from any deal between users. If we are found liable, our total liability is limited to the amount you paid us in the past 12 months, or $100, whichever is greater.
10. Indemnity
You agree to cover our costs for any claim arising from your content, your services, or your breach of these terms.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
12. Changes and contact
